The ‘Garden Club’ is the name for Waterside Garden Centre Ltd’s loyalty card scheme that rewards members with loyalty points (points) redeemable in store when they make qualifying purchases at Waterside Garden Centre.
Monthly Restaurant Promotion Vouchers may be issued within newsletters or e-newsletters as part of the Garden Clubs rewards.
Free gift vouchers or exclusive offers may also on occassion be issued within the newsletters or e-newsletters.
These terms and conditions (the ‘Conditions’) set out the terms on which you can join the Garden Club, earn points and to how to spend the points at Waterside Garden Centre. They are also the terms on which Waterside Garden Centre Ltd can use your personal information.
Joining the Garden Club and using your Card
Your name, full postal address and/or email address, must be provided for a Card to be registered. Applicants must be aged 16 or over and must have a resident UK, Channel Island or Isle of Man address. Waterside Garden Centre reserves the right to refuse an application for any good reason.
Your address / email address can only be linked to one Garden Club membership. If you’d like a second Garden Club membership (for your partner for example), you’ll need a second email address to complete your registration. You can’t transfer or copy your card, and it can only be used by the named and registered member. If members of your family over 16 wish to have a card, they’ll need to join as members with their own email address.
Your Card is issued by, and remains the property of, Waterside Garden Centre. It must be returned to Waterside Garden Centre on request or destroyed when no longer valid for use. Your Card is not and must not be used as a credit card, guarantee card or as any other form of security against sums you might owe to third parties.
If you do not register your Card you will not be able to redeem your points nor will you be eligible for other Garden Club offers and promotions which run from time to time.
If you breach these Conditions, or if Waterside Garden Centre reasonably believes that you have breached these Conditions and/or abused Waterside Garden Centre, Cards may be terminated without prior notice. Waterside Garden Centre reserves the right to take any action deemed necessary where a Card is found to have been used in a way that abuses Waterside Garden Centre.
In addition to section 2.4 above, Waterside Garden Centre also reserves the right to: (a) stop issuing Cards at any time; (b) on notice to you, alter or amend these Conditions of operation of the Card and/or Garden Club; and (c) on notice to you, withdraw or cancel the Cards and/or the points and/or terminate the Garden Club.
You may terminate your Card at any time in which case all points on the Card shall be lost.
You are responsible for the security of your Card. If you believe an unauthorised person has compromised the security of the Card by, for example, its theft or the theft of personal or password information relating to it you should notify Customer Services immediately. Lost, damaged or stolen Cards can be replaced by contacting Customer Services. A Card should be treated like cash. Waterside Garden Centre is not responsible for any unauthorised use of the Card.
Any Card issued is personal to the person whose personal details were submitted with their registration. A Card and any points on it are non-transferable, and can only be used by the registered cardholder.
The Garden Club is not open to employees of Waterside Garden Centre.
You must keep us informed of any changes to your personal or membership details. We will not be responsible for any loss of points or benefits resulting from details being out of date or inaccurate.
You can only use your Garden Club card in Waterside Garden Centre. Points are excluded on purchases of garden buildings, concessions, selected offers and day trips.
To collect points in store, you must present your Card at the till at the time of purchase or within 30 days of the date of purchase. In the case of the latter, proof of purchase, using a validated till receipt, will be required for the points to be credited to the Card. You cannot claim points on purchases made before joining the Garden Club.
You will receive points on qualifying transactions. In-store points are awarded for every £1.00 spent or a pro rata amount rounded up or down to the nearest point depending on the capabilities of the Garden Club’s software systems. These rates can be altered at the Waterside Garden Centre’s discretion on reasonable notice. The number of points issued may vary between qualifying purchases. Points will be awarded on merchandise sold at Waterside Garden Centre as outlined below:
2 points per £1 spent on all products within the garden centre and restaurant.*
* excludes purchases for garden buildings, vouchers, schemes, delivery charges, day trips, on-line store, concessions and occasionally on certain promotional /sale items.
Waterside Garden Centre reserves the right to offer bonus points on certain products as selected by Waterside Garden Centre from time to time in its sole discretion.
Each point has a redemption value of 1p, for use in store only. 200 points is the minimum points total for redemption. Waterside Garden Centre reserves the right to vary the rates at any time on reasonable notice. All points awarded have no monetary value.
Points have no expiry date but are lost if the relevant Card account is closed or the Garden Club ends, noted in section 2.5 and 9.5. When points are redeemed your Garden Club points balance will be reflected.
If Waterside Garden Centre reasonably suspect abuse, fraud or misconduct in respect of use of the Card, it may refuse to issue and/or cancel points. You may not rely on any human or software error which results in the award of points to which you are not entitled under these Conditions.
Points are personal to you, non-transferable and cannot be exchanged for cash. They can only be used when presented with the registered Card.
(a) Waterside Garden Centre may vary these Conditions and will give Cardholders as much notice as it reasonably can. Such variations will also be published at Waterside Garden Centre and on its website at www.watersidegardencentre.co.uk. Earning further points following such variation shall constitute acceptance of the changes Waterside Garden Centre makes.
(b) If Waterside Garden Centre decides to transfer the scheme to another legal entity it may transfer all of its rights and obligations under these Conditions without your consent and may disclose information about you to any potential or new owner.
(c) Waterside Garden Centre will only be liable to Cardholders for losses Cardholders suffer from Waterside Garden Centre’s breaches of these Conditions. Subject to point 3.6 above, Waterside Garden Centre’s sole liability shall be to credit to the relevant account any points that have been wrongly deducted or should have been credited but were not.
(d) Waterside Garden Centre and Cardholders rights and obligations under these Conditions and any dispute in relation to them shall be governed by English law and heard to the exclusion of all other forums in the English courts. Waterside Garden Centre’s obligations to Cardholders in respect of the Garden Club are contained in these Conditions and nowhere else.
(e) The Garden Club card must be presented when returning any goods allowing us to credit/debit the appropriate points.
To receive marketing information from us you’ll also need to consent. Please rest assured your information will never be passed to any company outside the Waterside Garden Centre Group for them to use for their mailing or marketing purposes.
Restaurant Promotion Vouchers
On occassions Garden Club members will be issued Restaurant Promotion Vouchers within newsletters or e-newsletters which entitle the member to the promotion printed on the voucher in the Oasis Restaurant. The Restaurant Promotion Vouchers are labelled with a specific date range; they are only redeemable within this date range.
Restaurant Promotion Vouchers remain the property of Waterside Garden Centre.
Waterside Garden Centre reserves the right to refuse Restaurant Promotion Vouchers on reasonable grounds. Reasonable grounds include abuse or attempted abuse of the Garden Club, using Restaurant Promotion Vouchers in a manner that contradicts the Terms and Conditions and any suspicion of dishonesty within Waterside Garden Centre or in connection with the Garden Club.
Restaurant Promotion Vouchers have no monetary value and may not be redeemed or exchanged for anything other than stated in 4.1.
Members are required to show their Card when using a Restaurant Promotion Voucher.
Lost Restaurant Promotion Vouchers will not be replaced.
Free Gift Vouchers
On occassions Garden Club members will be issued Free Gift Vouchers within newsletters or e-newsletters which will entitle the member to one free gift as described on the voucher to use at Waterside Garden Centre. The Free Gift Vouchers are labelled with a specific date range; they are only redeemable within this date range.
Free Gift Vouchers remain the property of Waterside Garden Centre.
Waterside Garden Centre reserves the right to refuse Free Gift Vouchers on reasonable grounds. Reasonable grounds include abuse or attempted abuse of the Garden Club, using Free Gift Vouchers in a manner that contradicts the Terms and Conditions and any suspicion of dishonesty within Waterside Garden Centre or in connection with the Garden Club.
Free Gift Vouchers have no monetary value and may not be redeemed or exchanged for anything other than stated in 5.1.
Members are required to show their Card when using a Free Gift Voucher.
Waterside Garden Centre holds in stock a reasonable quantity of the Free Gift offered. When this stock is used up the free gift offer ends. Alternatively Waterside Garden Centre may decide to offer an alternative to the described Free Gift during the specific date range.
Lost Free Gift Vouchers will not be replaced.
Exclusive Offers & Exclusive Offer Vouchers
On occassions Garden Club members will have access to Exclusive Offers. These will be shown within newsletters or e-newsletters and will entitle the member to the exclusive offer as described (within the newsletter or e-newsletter or on the voucher) to use at Waterside Garden Centre. These Exclusive Offers are labelled with a specific date range; they are only redeemable within this date range.
Any Exclusive Offer Vouchers remain the property of Waterside Garden Centre.
Waterside Garden Centre reserves the right to refuse members taking advantage of Exclusive Offers on reasonable grounds. Reasonable grounds include abuse or attempted abuse of the Garden Club, using the exclusive offers in a manner that contradicts the Terms and Conditions and any suspicion of dishonesty within Waterside Garden Centre or in connection with the Garden Club.
Exclusive Offers have no monetary value and may not be redeemed or exchanged for anything other than stated in 6.1.
Members are required to show their Card when using any Exclusive Offer.
Waterside Garden Centre holds in stock a reasonable quantity of the Exclusive Offer. When this stock is used up the Exclusive Offer ends. Alternatively Waterside Garden Centre may decide to offer an alternative to the described Exclusive Offer during the specified date range.
Lost Exclusive Offer Vouchers will not be replaced.
Any Exclusive Offer Vouchers which offer money off, cannot be redemmed against Waterside Gift Vouchers or HTA Gift Vouchers.
What information we collect:
By joining up to the Garden Club and providing your personal data you agree to your name, postal address and/or email address and other personal data you supply (‘personal data’) being held on record.
How we use your information:
(a) To administer our Garden Club and business.
(b) With your agreement, to send the following by e-mail and/or by post: (i) ‘Garden Club’ mailings and notification of any programme changes. (ii) marketing and promotional materials about goods and/or services on offer at Waterside Garden Centre and Waterside Garden Centre’s websites (iii) details of events and any other information that we believe will be of interest to you. You can cancel your Garden Club membership at any time by contacting firstname.lastname@example.org or calling us on 01778 560000.
We would like to send you information about products and services of ours which may be of interest to you. If you have consented to receive marketing, you may opt out at a later date by clicking the unsubscribe link in the footer of any email you recieve from us, or by contacting us at: email@example.com or call 01778 560000.
Retention of your information:
We will hold your personal data on our systems for a maximum of 3 years to administer your membership with the Garden Club. If after 3 years your membership has remained unused your membership will be cancelled and all information removed. If you cancel your membership we will remove your details on our database (within 30 days).
Security of your information:
Your personal data shall only ever be held and stored on secure and encrypted computer servers. The Garden Club confirms that it has in place adequate safety and security measures to keep your personal information safe and secure in accordance with its obligations under the Act.
We sometimes share your data with trusted third parties. Examples of the kind of third parties we work with are: (i) IT companies who support our website and other business systems. (ii) Operational companies such as delivery couriers. (iii) Direct marketing companies who help us manage our electronic communications with you.
Access to Personal Data:
The Act gives you the right to access information held about you by the Garden Club. Your right of access can be exercised in accordance with the Act. You have the right to request:
(i) for a copy of your information
(ii) for information to be corrected
(iii) for information to be erased or deleted
(iv) for us to limit or restrict processing
(v) to object to us processing your data, in particular where we use the data for direct marketing, including profiling for direct marketing purposes.
The right to object does not apply if we must process the data to meet a contractual or legal requirement. Some rights, however, may be limited. We may be obliged by law or regulation to keep information. We must respect other people’s privacy as well, which means we may need to redact or remove information where it includes personal data about someone else, even if it is connected to your data. On occasion there may be a compelling legitimate interest to keep processing data. If you want a copy of your data, to object to how we use your data, or ask us to delete it or restrict how we use it, please see ‘Contact details’ below. To process a request from you, we may need to confirm your identity to ensure we’re accessing the right data.
