Garden Club Terms & Conditions
1. Introduction
1.1 The 'Garden Club' is the name for Waterside Garden Centre’s loyalty card scheme that rewards members with 'Reward Points ('points') redeemable in store when they make qualifying purchases at Waterside Garden Centre.
1.2 Monthly free drinks vouchers will be issued within the newsletter on a monthly basis as part of the Garden Clubs rewards.
1.2 These terms and conditions (the 'Conditions') set out the terms on which you can join the Garden Club, earn points and to how to spend the points at Waterside Garden Centre. They are also the terms on which Waterside Garden Centre can use your personal information.
1.3 If you apply to join the Club or use a Card you automatically accept these Conditions.
2. Joining the Garden Club and using your Card
2.1 Your name, full postal address and/or email address, must be provided for a Card to be registered. Applicants must be aged 16 or over and must have a resident UK, Channel Island or Isle of Man address. Waterside Garden Centre reserves the right to refuse an application for any good reason.
2.2 Your Card is issued by, and remains the property of, Waterside Garden Centre. It must be returned to Waterside Garden Centre on request or destroyed when no longer valid for use. Your Card is not and must not be used as a credit card, guarantee card or as any other form of security against sums you might owe to third parties.
2.3 If you do not register your Card you will not be able to redeem your points nor will you be eligible for other Garden Club offers and promotions which run from time to time.
2.4 If you breach these Conditions, or if Waterside Garden Centre reasonably believes that you have breached these Conditions and/or abused Waterside Garden Centre, Cards may be terminated without prior notice. Waterside Garden Centre reserves the right to take any action deemed necessary where a Card is found to have been used in a way that abuses Waterside Garden Centre.
2.5 In addition to section 2.4 above, Waterside Garden Centre also reserves the right to: (a) stop issuing Cards at any time; (b) on notice to you, alter or amend these Conditions of operation of the Card and/or Garden Club; and (c) on notice to you, withdraw or cancel the Cards and/or the points and/or terminate the Garden Club.
2.6 You may terminate your Card at any time in which case all points on the Card shall be lost.
2.7 You are responsible for the security of your Card. If you believe an unauthorised person has compromised the security of the Card by, for example, its theft or the theft of personal or password information relating to it you should notify Customer Services immediately. Lost, damaged or stolen Cards can be replaced by contacting Customer Services. A Card should be treated like cash. Waterside Garden Centre is not responsible for any unauthorised use of the Card.
2.8 Any Card issued is personal to the person whose personal details were submitted with their registration. A Card and any points on it are non-transferable, and can only be used by the registered cardholder.
2.9 The Garden Club is not open to employees of Waterside Garden Centre.
3. Reward Points
3.1 To collect points in store, you must present your Card at the till at the time of purchase or within 30 days of the date of purchase. In the case of the latter, proof of purchase, using a validated till receipt, will be required for the points to be credited to the Card. You cannot claim points on purchases made before they joined the Garden Club.
3.2 You will receive points on qualifying transactions. In-store points are awarded for every £1.00, spent or a pro rata amount rounded up or down to the nearest point depending on the capabilities of the Garden Club's software systems. These rates can be altered at the Waterside Garden Centre’s discretion on reasonable notice. The number of points issued may vary between qualifying purchases. Points will be awarded on merchandise sold at Waterside Garden Centre as outlined below:
3 reward points per £1 spent on all products within the centre*
5 reward points per £1 spent on all plants within the centre**
* excludes purchases in the decking village, garden buildings, vouchers, schemes, delivery charges, restaurant and coffee shop, on-line store, concessions and occasionally on certain promotional /sale items.
** excludes purchases of seeds, bulbs and occasionally on certain promotional / sale items.
3.3 Waterside Garden Centre reserves the right to offer bonus points on certain products as selected by Waterside Garden Centre from time to time in its sole discretion.
3.4 Each point has a redemption value of 1p, for use in store only. 200 points is the minimum points total for redemption. Waterside Garden Centre reserves the right to vary the rates at any time on reasonable notice. All points awarded have no monetary value.
3.5 Points have no expiry date but are lost if the relevant Card account is closed or the Garden Club ends, noted in section 2.5. When points are redeemed your Garden Club points balance will be reflected.
3.6 If Waterside Garden Centre reasonably suspect abuse, fraud or misconduct in respect of use of the Card, it may refuse to issue and/or cancel points. You may not rely on any human or software error which results in the award of points to which you are not entitled under these Conditions.
3.7 Points are personal to you, non-transferable and cannot be exchanged for cash. They can only be used when presented with the registered Card.
3.8 General Terms
(a) Waterside Garden Centre may vary these Conditions and will give Cardholders as much notice as it reasonably can. Such variations will also be published at Waterside Garden Centre and on its website at www.watersidegardencentre.co.uk. Earning further points following such variation shall constitute acceptance of the changes Waterside Garden Centre makes.
(b) If Waterside Garden Centre decides to transfer the scheme to another legal entity it may transfer all of its rights and obligations under these Conditions without your consent and may disclose information about you to any potential or new owner.
(c) Waterside Garden Centre will only be liable to Cardholders for losses Cardholders suffer from Waterside Garden Centre's breaches of these Conditions. Subject to point 3.6 above, Waterside Garden Centre’s sole liability shall be to credit to the relevant account any points that have been wrongly deducted or should have been credited but were not.
(d) Waterside Garden Centre and Cardholders rights and obligations under these Conditions and any dispute in relation to them shall be governed by English law and heard to the exclusion of all other forums in the English courts. Waterside Garden Centre's obligations to Cardholders in respect of the Garden Club are contained in these Conditions and nowhere else.
(e) The Garden Club card must be presented when returning any goods allowing us to credit/debit the appropriate points.
4. Drinks Vouchers
4.1 Garden Club members will be issued two Drink Vouchers within the monthly newsletter which each entitle the member to one free filter coffee or tea from the Oasis Restaurant. The drink vouchers are labelled with a month; they are only redeemable within this month.
4.2 Drink Vouchers remain the property of Waterside Garden Centre.
4.3. Waterside Garden Centre reserves the right to refuse Drink Vouchers on reasonable grounds. Reasonable grounds include abuse or attempted abuse of the Garden Club, using Drink Vouchers in a manner that contradicts the Terms and Conditions and any suspicion of dishonesty within Waterside Garden Centre or in connection with the Garden Club.
4.4 Drink Vouchers have no monetary value and may not be redeemed or exchanged for anything other than stated in 4.1.
4.5 Members are required to show their Card when using a Drinks Voucher.
4.6 Lost Drink Vouchers will not be replaced.
5. Data Protection
5.1 This section sets out how Waterside Garden Centre collects your personal data, how Waterside Garden Centre uses it and who Waterside Garden Centre shares it with. Under the Data Protection Act 1998 (the "Act"), your data controller is the legal entity that operates Waterside Garden Centre and Waterside Garden Centre’s websites.
5.2 Use of your personal data (a) By joining up to the Garden Club and providing your personal data you agree to your name, age, date of birth, postal address, email address and other personal data you supply ('personal data') being used by Waterside Garden Centre. (b) Club members also agree to their personal data being used by Waterside Garden Centre to send the following by e-mail and/or by post: (i) 'Garden Club' mailings and notification of any programme changes. (ii) marketing and promotional materials about goods and/or services on offer at Waterside Garden Centre and Waterside Garden Centre’s websites.
5.3 Waterside Garden Centre will not give out your personal data to any third party.
5.4 Retention: We will hold your personal data on our systems for as long as is necessary to administer your membership with the Garden Club. If you cancel your registration as a member we will 'red flag' your details on our database and retain your details on our database for the longer of 3 years for administration purposes or for any longer period required by law before deleting your profile automatically.
5.5 Security: Your personal data shall only ever be held and stored on secure and encrypted computer servers. The Garden Club confirms that it has in place adequate safety and security measures to keep your personal information safe and secure in accordance with its obligations under the Act.
5.6 Access to Personal Data: The Act gives you the right to access information held about you by the Club. Your right of access can be exercised in accordance with the Act. Any access request may be subject to a fee of £10 to meet our costs in providing you with details of the information we hold about you.
